NYC Mayor Michael Bloomberg's ban on large sodas was blocked by New York Supreme Court Judge Tingling

A judge with the state of New York has blocked NYC Mayor Michael Bloomberg’s ban on large sodas, one day before it was to go into effect.

New York Supreme Court Judge Milton Tingling said, “The simple reading of the rule leads to the earlier acknowledged uneven enforcement even within a particular city block, much less the city as a whole. The loopholes in this rule effectively defeat the state purpose of the rule.” The judge’s mandate prevents the city from implementing or enforcing any of the provisions of the original proposal. The city plans to appeal the decision as soon as possible.

The move comes as a huge blow to the health-conscious mayor’s initiative against obesity. According to the New York Post, Bloomberg said earlier today that the people he was trying to protect with the ban were those of lower incomes, because those apparently the people who, “don’t have the ability to take care of themselves as well.” The mayor had expected the move to pass without much fuss, despite vocal outcry from store and restaurant owners, but Judge Tingling felt differently.

The inconsistency of the original push was one of the main detractors to its success. The fact that restaurants couldn’t sell sodas over 16 oz. but establishments like movie theaters and chains like 7-Eleven could angered businesses and consumers alike, and the fact that drinks made with milk (like coffee drinks, some of which have even more calories) were exempt infuriated them further. The judge went on to say that the fact that consumers could get refills on the beverages would “defeat and/or serve to gut the purpose of the rule.”
