The San Francisco 49ers linebacker Aldon Smith is facing felony charges relating to possession of assault weapons from the Santa Clara District Attorney, reports NBC Bay Area.

The charges originate from a 2012 house party that Smith held were two of his guests were shot and Smith was stabbed.

Here’s what you need to know about the latest NFL controversy:


1. Smith is Already Facing Civil Charges Relating to the Shooting

Smith, although not named as the shooter, is being sued by his party guests as being responsible for the shooting at his home in San Jose in 2012. The suit states that Smith owned the guns that were fired and that his party had been advertised on the Internet.


2. He’s Also Facing a DUI Charge

In September 2012, Smith crashed his black pickup into a tree, investigating officers breathalyzed the 49er and found he was over the alcohol limit. Smith was also found in possession of marijuana. He was driving alone at the time.


3. He’s Played Just One Game For the 49ers This Season

Smith played in the 49ers loss Indianapolis Colts on September 22.


4. Smith Had a Previous DUI in 2012

In 2012, while driving in Miami, Smith was arrested by police for driving under the influence, reports USA Today.


5. He Makes Charitable Donations Based on His Sack Record

With Smith attempting to break the NFL’s sack record, he agreed to donate over $5,000 to Boys & Girls Club of San Francisco (Willy Mays Clubhouse at Hunters Point) and Boys & Girls Clubs of The Peninsula (East Palo Alto Clubhouse) in 2013.
