Rob Kardashian Revenge Porn: Could He Face Jail Time for Blac Chyna Pics?

Rob Kardashian started a firestorm of controversy on Wednesday morning when he released a series of series of sexually explicit photos of his baby mama Blac Chyna.

It started on Monday when he posted a video of Chyna kissing another man on Instagram with the caption “Hahahaha Chyna just sent me this video saying happy 4th of July what a crazy person. Come spend time with your daughter instead of [expletive] me and then this dude right after. U need help (sic).”

Afterwards, Kardashian posted several photos of Chyna’s private parts, which he claims Chyna sent him. Instagram deleted the photos, only to have Kardashian repost them– and subsequently get deleted again. Check out one of the edited posts below.

As details surrounding the feud continue to surface, many are wondering whether or not Kardashian broke any state laws. Could he potentially face jail time for his “revenge porn” photos of Chyna?

According to NY Daily News, the answer is yes. Technically, Kardashian has broken the California Revenge Porn Law, which, established in 2013, states the legal definition of revenge porn as follows:

    1. 1. You have an image of the intimate body part of another identifiable person, or an image of that person engaged in sexual intercourse, sodomy, oral copulation or masturbation.
      2. You intentionally distribute that image.
      3. There was an understanding between you and that person that the image would remain private.
      4. You know or should know that the distribution of the image will cause the person serious emotional distress.
      5. The person depicted suffers serious emotional distress.

One attorney who believes that Kardashian is in violation of this crime is civil rights attorney Lisa Bloom, who tweeted out a note of warning to the Keeping Up with the Kardashians (2007-) star. Read the full tweet below.

“Revenge porn is illegal in CA and it certainly appears to me that Rob has violated this criminal law,” Bloom told NY Daily News, “The criminal penalty is up to six months in jail. If she sued him for money damages, the amount she received would depend on the emotional distress she suffered. Given that he has a large social media following, if the jury was sympathetic to her, she could recover millions.”

As she alludes to in the tweet above, Bloom recently won a revenge porn case on behalf of actress Mischa Barton, forcing her ex-boyfriend to hand over any sexually explicit photographs and a sex tape from the couple’s relationship.

That being said, TMZ did offer a different angle on the Kardashian-Chyna situation. They claim that Chyna “liked” the photos that Kardashian posted on Instagram, making it potentially hard to convince a judge that she suffered emotional distress. Additionally, TMZ reports that Chyna would “never” go to the police to file a report against the father of her child.

Kardashian has since deleted his Instagram account.
