Police Report: Ariana Biermann Refused On-Scene Breathalyzer, License Seized
Heavy obtained the full police report of the incident which revealed why Biermann was pulled over, to begin with.
“I observed two vehicles get into an accident in the intersection of Peachtree Pkwy and Hwy 400SB off ramp,” the arresting office wrote in their report. The report states that Biermann’s Black Merceded G-Wagon turned right from the left turn lane and hit a Blue Ford Focus.
“I could smell a light odor of alcoholic beverage coming from her breath as she spoke to me. She denied consuming any alcoholic beverage,” the police officer wrote. “I advised her that I could smell the odor of alcoholic beverage on her breath. She stated that the odor was possibly coming from her clothing.”
According to the report, Biermann admitted to smoking a THC vape pen and the officer “observed signs of impairment” including a “noticeable sway.”
The office says in the report that they then asked her to “provide a breath sample” and she “refused.”
The police officer then placed her under arrest and handcuffed her. From there Biermann consented to a blood test, whcih would be conducted at the station. When she arrived there, she then refused.
“Ariana stated that she no longer wanted to consent to the blood test,” and her driver’s license was “seized.”
Biermann Arrested & Charged With DUI, ‘Underage Alcohol Possession’ & a Traffic Offense, While Her Boyfriend Was Also Taken Into Custody
Ariana Biermann, Zolciak’s 20-year-old daughter, was arrested and booked on three charges, including misdemeanor driving under the influence, jail records viewed by Heavy show. Along with DUI, she was also charged with underage possession of alcohol and improper/erratic lane change, which is also a misdemeanor, records show. She was arrested by the Forsyth County Sheriff’s Office.
According to an online police record search, Biermann was booked under Zoliciak despite being adopted by her step-father Kroy Biermann. Her arrest, or the time it was entered into the system, was approximately 1:30 a.m. and took place at 2291 Atlanta Highway. The location, according to Google Maps, is a gas station.
Records obtained by Heavy show Biermann was bonded out of the Forsyth County jail at 2:07 a.m. on August 13. It was not immediately clear how much her bond was set at.
Biermann’s boyfriend, Hudson McLeroy, was also arrested, TMZ first reported. He bonded out of jail at 2:14 a.m., records show. The amount of his bail was also not known. McLeroy, also 20, was charged with driving under the influence, violating his driving permit and furnishing/purchasing alcohol under 21, jail records show.
Justin Spizman, Ariana’s lawyer, told TMZ in a statement: “Ariana was involved in a minor fender bender. When police arrived on scene, the investigating officer immediately initiated an investigation for DUI. Despite Ariana’s constant invocation that she was upset and anxious from the minor accident, the officer incorrectly concluded she was impaired by alcohol. That was not the case. She wholly denies these allegations and intends to fight these charges because she is not guilty of them.”
Heavy reached out to Zolciak’s rep for comment and has not received a response.
