Retired Lieutenant General Michael Flynn, the disgraced National Security Adviser to President Donald Trump, is expected to decline the Senate Intel committee subpoena and plead the fifth today over his Russia contacts, reports AP.

Flynn resigned from the Trump administration in February after admitting he gave “incomplete information regarding my phone calls with the Russian Ambassador.” Prior to his resignation, questions had been raised that Flynn violated the Logan Act by discussing sanctions with Russian Ambassador Sergey Kislyak in December when President Barack Obama announced sanctions against Russia. The Logan Act was established in 1799 by President John Adams and is named after George Logan, an American collaborator with France. The Act was most recently amended in 1994, and violation of the Act is a felony. The federal law states that any unauthorized citizen is barred with negotiating with a foreign government that is in currently in dispute with the United States.

According to CNN, “The Senate committee had asked Flynn earlier this month to produce all records over his communications with Russian officials by this Wednesday. But Flynn is expected to send a letter later Monday invoking his Fifth Amendment rights.”

Several members of Congress have called for his prosecution.
