Judge Cinderela Guevara: 5 Fast Facts You Need to Know

Judge Cinderela Guevara, also known as Cindy Rice Guevara, is the Texas judge who announced Justice Antonin Scalia’s cause of death without seeing his body or ordering an autopsy. Who is Judge Guevara? Why did she decide an autopsy wasn’t necessary? Has she done anything like this before? Guevara was a justice of the peace for 25 years before being elected as Presidio County’s first female county judge. One of her past cause of death rulings for a different case also generated quite a bit of controversy.

Here’s what you need to know.


1. She Announced Scalia’s Cause of Death & Said There Was No Need for an Autopsy, Without Seeing His Body

Guevara’s ruling about Scalia’s death was controversial because she announced the cause of death without seeing his body. Although this is allowed by Texas law, many questioned her decision. According to WFAA 8, Guevara said she was shopping in the nearby town of Alpine when the Presidio County Sheriff called her and said a Supreme Court Justice had passed away at Cibolo Creek Ranch and he needed someone there immediately because both justices of the peace were out of town. For the next 20 minutes, they called back and forth because cell reception was spotty in that area. She pronounced him dead over the phone at 1:52 pm and planned to drive to the ranch. However, she turned back when a U.S. Marshal told her it wasn’t necessary and they only needed to know if Scalia needed an autopsy. She told WFAA that she asked the sheriff if there were any signs of foul play and he said no.

Scalia’s doctor called her around 8 p.m. that night and said he had done an MRI on Scalia a few days earlier and felt comfortable with knowing what had happened to him. The MRI was for a shoulder injury, but Scalia had several chronic ailments too. At that point, Guevara said she felt comfortable not requesting an autopsy.

2. Media Reports Said Guevara Misspoke About Scalia’s Dying of a Heart Attack

Early media reports stated that Guevara had ruled Scalia died of a heart attack. But exactly what Guevara had said is a bit confusing. According to WFAA, Guevara told them that Scalia’s heart stopped beating in his sleep, hours after telling them that a heart attack would likely be the cause of death. However, The Washington Post reported that she said she didn’t tell anyone that he died of a heart attack. Meanwhile, Reuters reported that Guevara had said in an interview that she misspoke when telling WFAA that Scalia died of a heart attack. Instead, she said he would be reported as dying of natural causes.

Whatever exactly happened, Guevara chose not to order an autopsy. Juanita Bishop, a justice of the peace in Presidio, Texas, said that she would have ordered an autopsy if she had been the one to respond to the call, The Washington Post reported.

3. She Was Elected Presidio County’s First Female Justice of the Peace and First Female County Judge

Guevara has a long history of making history. She was elected as Presidio County Judge in March 2014, when she gained the distinctive title of being the county’s first Mexican American woman to hold that position, Big Bend Now reported. Guevara won the election after serving for 25 years as the Presidio County Precinct 1 Justice of the Peace. When she was elected justice of the peace, she also made history by being the first woman elected to that position in the county, News West 9 reported.

Guevara doesn’t believe in playing favorites. She told the Express News that if she was elected to the top county position, she hoped it would be because of her fairness. “I hope people see that I treated everyone the same, and that is what helped me to become county judge,” she said.

4. When Guevara Ruled that a Young Woman’s Death Was a Suicide in 2013, Her Decision Was Very Controversial

This isn’t the first time Guevara has been the source of controversy. In 2013, Melaney Parker Rayburn was found dead after being hit by a train in Marfa, Texas. She had just been married a few months earlier. Liz Parker, Melaney’s mom, questioned how Guevara handled the investigation of her daughter’s death, The Daily Kos reported. Melaney was hit by a Union Pacific Railroad train and, Liz wrote, a Union Pacific representative told her that it appeared that her body had been placed on the tracks while she was unconscious. Liz asked the Justice of the Peace and the Sheriff to open the case as a homicide investigation, but they would not. Guevara, who was a Justice of the Peace at the time, did not order a rape kit or an autopsy, Liz wrote, because a doctor at the scene said the cause of death was obvious.

Liz later wrote a letter to the editor, published in Big Bend Now, in which she said that Guevara had asked for God to give her an answer about whether Melaney’s death was suicide. Liz wrote that Guevara told her: “Yes, this was a tragedy, but the true tragedy was that she died without accepting Jesus Christ as her savior.”

Big Bend Now also published a story about the controversial investigation. Melaney’s cousin, Aspen Parker, wrote a letter to Fox News in 2013 saying that Guevara’s cause of death ruling mentioned that Melaney had submitted a letter of resignation to her employers before her death. Aspen wrote that he called Melaney’s employers and they said that wasn’t true.

      • And you were able to gather that from her statement …. “Guevara told her: “Yes, this was a tragedy, but the true tragedy was that she died without accepting Jesus Christ as her savior.”” …. which is something only extreme far right conservatives say to a grieving parent?

    • In Texas the title “County Judge” is misleading as anyone can become a County Judge simply by running a campaign for the slot . . . no legal training needed and no real understanding of the “Real Responsibilities” of the slot. She asked the sheriff and he told her what he thought about cause of death, so she pronounced him as stated.

      This is not to demean the County Judge, but she simply deferred to the Sheriff who also was not a trained physician.

      The real coincidences, looking like the “clinton crime family” history and the need for “the rodham” to have a Pardon waiting, combined with obama’s need to get a radical Justice on the Supreme Court . . . . makes a quid pro quo in politics.

    This is the second time she has blatantly proven she has less than poor judgement and is willing to sacrifice justice. Had she done everything she could (a little effort, perhaps?) there wouldn’t be room for conspiracy theories. After what she didn’t do for Rayburn-Parker, and then again, to Scalia. I am glad she’s being called out for being a lazy fat butt. She should have put down the burger and taken her buns to the scene.

    • And she did say from her own lips that he died from a “myocardial infarction” which she couldn’t even pronounce. then she backed away from that statement. What was it Your Honor? Heart attack? Smothering? Poison? Oh, that’s right. You don’t know because YOU DIDN’T ORDER AN AUTOPSY!

  2. I bet that you guys didn’t even know that Cindy Rice aka Cinderella Rice aka Cindy Guevara aka Cinderella Guevara HAS NEVER EVEN STEPPED FOOT IN LAW SCHOOL FOR EVEN ONE DAY. In Texas county judges and justices of the peace are ordinary private citizens without any legal knowledge. Obama ordered him poisoned or killed. Show me the autopsy results and the toxicology screening.

    • In New York, JPs don’t have to be attorneys, but certainly supreme/superior county judges HAVE to have law degrees and be a member in good standing with the State Bar. This story is becoming more nightmarish every day.

  3. This is so ridiculously incompetent or malevolent that I can’t help but wonder if this is a case of affirmative action in action!? Who does Cinderela answer to, and why was her decision not to have an autopsy on Scalia contested!? For goodness sake, the man died with a PILLOW OVER HIS FACE, how is that a natural death!? It seems like normal procedures were chucked out the window in order to have the body quickly disposed of. No one dares to do the right thing. These actions seem like a cover-up and threat to anyone who will not grant the ptb what they want. More skulduggery from the insane perps in government… we will someday look back and realize that the Constitution went down with Scalia!

  5. I noticed everyone seems to be looking at the Judge. I have to say she is not a detective. Sheriff Danny Dominguez made the call as to as to no foul play. I know for a fact he’s not much of an investigator and has little knowledge in being a peace officer. I noticed he did the same thing with Melaney Parker. He only took a few photos and returned her purse to her mother with what might have contained evidence. From there Sheriff Dominguez had the volunteer fire department wash away the scene. I think questions should be asked if the scene was handled correctly. I doubt it was.

  6. so we do an autopsy on a gang member shot by police in Chicago, but not on a supreme court justice ? got news for Cinderella 80% of America thinks your insane. the majority thinks this guy was murdered and that says a lot about what the democrats will do or at least what the average citizen thinks they are capable of doing and its a glaring reason not to give either one of them a vote.     To not order an autopsy? Again?? She did this to a local family, then to a nationally known public figure. What is wrong with this picture? The definition of insane is doing the same thing over and over expecting a different result. I trust that Melaney’s family will decide to sue this a_hole for emotional damages. Any good attorney would take this case just for the publicity at this point. And, btw.. church and state, dumb ass, church and state. Pray bitch, I hope you can be forgiven.   8. Lemme guess….a liberal, Latino, democrat “judge” with a history of ‘controversial murder decisions’ is the one out of the entire state of Texas they call. Nah, couldn’t possibly be a random chance thing here. This was sealed up way too quick as a cover for the probable suffocation death of Scalia or possible poisoning. Now that the embalming is done, that evidence is gone.

    • If they disinter him,and examine his face, they will be able to tell at least if he was smothered or strangled because when a person is being smothered the small blood vessels in the face and around the eyes break for lack of oxygen. They can still find out a lot even if he has been “pickled.”

  10. I’m confused. The hyperlinked article on the woman whose body was found mangled by a train says that Judge Cinderela ORDERED AN AUTOPSY. What happened here? Was an autopsy ordered or not? Or this an example of revisionist history on the internet?? (Quote from article: “The victim was identified as Melaney Parker Rayburn, said Presidio County Justice of the Peace Cinderela Guevara, who pronounced the woman deceased at the scene and ordered an autopsy.”)

  12. I no longer trust either the government or the media. It’s very, very clear what people are willing to do for money. They’ve done this to themselves. If I had to say one way or the other I would say he was more than likely murdered. I also have to say if my husband turned up dead, regardless of any health issues, I would want to know the cause of death. If he was that sickly or had a bad heart I sure wouldn’t have let him go off on a hunting trip by himself and how convenient no security too. This whole story stinks and it’s mainly because the people telling it have changed their stories so many times. Just way too many anomalies like so many others having to do with government. They don’t add up.

  13. This is just horrible. I have never felt so aggrieved as an American citizen as I do now. This stupid woman (judge) is not above Texas law, and frankly, I don’t believe his death was of natural causes. Otherwise, why would have been handled so poorly. I am embarrassed to be a Texan.
