The FBI has released a video showing the fatal shooting of Oregon standoff spokesman LaVoy Finicum, who was killed by police during an operation to arrest the leaders of the Malheur National Wildlife Refuge takeover.

The video was recorded Tuesday by a plane that was flying above the FBI and Oregon State Police operation. It does not have audio.

The shooting happened on Highway 395 as Finicum and other leaders of the refuge takeover drove to a town hall about 30 miles from Malheur.

Finicum, 55, had previously told reporters he would rather die than surrender. But his family and other supporters have said he was not armed and was shot with his hands in the air.

The FBI said in a statement that in the video, “Finicum reaches his right hand toward a pocket on the left inside portion of his jacket. He did have a loaded 9 mm semi-automatic handgun in that pocket.”

The leader of the takeover, Ammon Bundy, his brother Ryan, and nine others have been arrested on federal charges. Ryan Bundy also suffered a minor gunshot wound. The 10 men and one woman face a charge of conspiracy to impede officers of the United States from discharging their official duties through the use of force, intimidation, or threats. They all remain in custody.

The FBI says four armed occupiers remain inside the wildlife refuge. Law enforcement has set up a “containment” around the refuge, and is not allowing anyone inside. Those in the refuge have said they do not want to come out because they are afraid of being arrested.
